Australia Marriage and Fiancée Visa

In Australia, when two people intend to get married and one is an Australian citizen, the couple can apply for specific visas like 482 visa in Australia and 189

visa invitation round depending on the couple’s current situation.

But for most non-Australian

and Australian couples, the Prospective Marriage subclass 300 visa is always a must, especially when the two intend to stay in Australia for good. The visa’s processing usually takes 12-17 months before the issuance of the temporary visa residence. This visa allows a person to enter Australia and get married in a 9-month period. Subclass 300 is then followed by an application for Partner subclass 820 (temporary partner visa) and 801 (permanent partner visa), which usually takes over five years to complete before granting permanent residency.

The NOIM

Notice of Intended Marriage or NOIM is a document that proves that the couple lodged with the person who will conduct the ceremony in 1–18-month before the target date of the ceremony. This notice serves as a confirmation that the Department may request upon verification of the visa.

When Must the Marriage Take Place?

The marriage should take place within the 9-month visa time frame. Suppose the couple failed to marry within the given period, there will be no more provision for another prospective marriage visain Australia. Still, the couple may re-apply subclass 300 visas offshore.

Do You Really Have to Marry in Australia?

The couple’s marriage venue doesn’t necessarily need to happen in Australia. The marriage ceremony can happen anywhere around the world, but the couple has to make sure that it occurs within the 9-month visa period to go back to Australia to proceed with the 820 and 801 applications.
